Terms of service
These terms apply to every use of Wholetally (the website, the dashboard, the API, the MCP server, the script and the edge collector, together “the service”). By creating an account you accept them. If you accept on behalf of an organisation, you confirm that you may bind it.
1. Provider
- Wholetally is a service of MAAT Automation, a Dutch sole proprietorship (eenmanszaak) operated from the Netherlands.

2. Who can use the service
The service is for businesses only: companies, organisations and professionals acting in the course of their trade, business or profession (“customer”, “you”). We don’t contract with consumers. When you sign up you accept these terms and confirm that you act for a business. If you accept them on behalf of an organisation, you confirm that you may bind it. You must be at least 18 years old.
3. Free trial
- A new account gets a 30-day free trial. No payment details are needed. You need a verified email address. One trial per account and per website domain.
- The trial includes the features of the plan shown in the dashboard and 100 AI credits. We remind the account owner by email before the trial ends.
- The trial ends automatically after 30 days; nothing is charged unless you choose a paid plan. After the trial, statistics are paused until you choose a plan; we keep collecting data for your sites. You can close the account at any time (section 13).
- Features can change, be added or be removed, also during the trial.
4. Account
- You sign in with your email address and a password. Keep your password, access to that mailbox (used for password resets) and your API tokens secure.
- You are responsible for everything done with your account and tokens. Tell us at once at hello@wholetally.com if you suspect misuse.
- Give us correct contact and billing details and keep them up to date.
5. Your responsibilities for the data you collect
- You are the controller of the analytics data collected on your websites. You decide whether and how to use the service there, inform your visitors (for example in your privacy policy), and determine whether consent is needed in your situation.
- You must not send personal data to the service in custom events, properties, page addresses or revenue metadata (for example email addresses or names in URLs), and no special categories of personal data at all.
- You follow the acceptable use policy.
- The data processing agreement forms part of these terms and applies automatically.
6. Plans, prices and AI credits
- Plans differ by monthly page views, number of sites and members, features and included AI credits. The current prices are shown on the pricing page and in the dashboard before you order. Prices are in euros and exclude VAT.
- Paid plans are billed in advance per month or per year through Stripe and renew automatically until you cancel. You can cancel at any time in the dashboard; the plan then ends at the end of the paid period. Paid periods are not refunded, except where the law requires it.
- If you go over your plan’s page views, we keep counting and don’t charge overage fees. A single month over changes nothing. If you go over two months in a row, we email you and suggest a suitable plan. If you don’t move up within 7 days, we pause access to your statistics in the dashboard until you do; collection continues.
- AI credits included in a plan are valid for the month they are granted. Purchased credit packs stay valid as long as your account is active. Credits have no cash value, can’t be transferred and are not refunded, except where the law requires it. Spending limits may apply.
- We may change prices with at least 30 days’ notice by email. A change takes effect at your next renewal; you can cancel before then.
- If a payment fails, we may suspend paid features after a reminder and a reasonable period to pay.
7. No consumer contracts
Because the service is offered to businesses only, the consumer right of withdrawal does not apply. If you signed up as a consumer despite section 2, tell us at hello@wholetally.com and we will close the account.
8. Intellectual property
We keep all rights to the service, its software, design and documentation. You get a non-exclusive, non-transferable right to use the service during your subscription. Your data stays yours: you can export it through the dashboard or the API at any time. The tracking script may be loaded and served from your own domain as described in the documentation.
9. AI features
AI answers, explanations, funnel suggestions and summaries are generated automatically and can be wrong or incomplete. Check them before you rely on them for decisions. See the AI-use statement.
10. Availability and changes
We make reasonable efforts to keep the service available and secure, but we don’t promise uninterrupted or error-free operation. We may carry out maintenance, and we may change the service as long as the core function of a paid plan stays available during the paid period.
11. Liability
- Our total liability under or in connection with the agreement is limited to the fees you paid us in the 12 months before the claim, with a maximum of €1,000.
- We are not liable for indirect damage, such as lost profit, lost revenue, lost data or reputational damage.
- These limits don’t apply to damage caused by our intent or deliberate recklessness (opzet of bewuste roekeloosheid), or where the law does not allow limitation.
- You must report damage to us in writing within 12 months after you discovered it, or the claim lapses.
12. Force majeure
We are not liable for failures caused by circumstances beyond our reasonable control, including outages of hosting, network or payment providers, and attacks on the internet infrastructure.
13. Suspension and termination
- You can close your account at any time in the dashboard or by email.
- We may suspend or end your account if you seriously breach these terms or the acceptable use policy, if you don’t pay, or if the law requires it. Where reasonable, we warn you first and give you time to fix it.
- After the account ends, you have 30 days to export your data. After that we delete it, as described in the data processing agreement.
14. Changes to these terms
We may change these terms. We announce material changes by email at least 30 days before they take effect. If you don’t agree, you can cancel before that date.
15. Governing law and disputes
Dutch law applies. The Vienna Sales Convention (CISG) does not apply. Disputes are submitted to the competent court in Amsterdam, the Netherlands.
16. Other
If a provision is invalid, the rest remains in force and the invalid provision is replaced by a valid one that comes closest to its purpose. General terms of the customer don’t apply. Notices to us go to hello@wholetally.com; notices to you go to the email address of your account.
